1. Overview
The interested boat manufacturers receive clear guidance on the following, after their enquiry :
(i) Information on the compliance requirements according to the Law 30 (I) /2002 for Essential Requirements for certain categories of Products in connection with Health, Safety and the Environment, as amended and the Regulations 2017 for the Essential Requirements ( Recreational Craft and Personal Watercraft ( PI 197/2017 ) for placing these products in the European market.
(ii) There is clear reference to the obligations of manufacturers
(iii) The manufacturer compiles the Declaration of Conformity as stipulated in Regulation 16 ( PI 197/2017 )and point out and places the CE marking , as stipulated in Regulations 18 and 19
(iv) Information in connection with the Watecraft Identification Number( WIN) and the assignment of manufacturer’s code by the Competent Authority, after receiving relevant application of the manufacturer, accompanied by a copy of a document proving the manufacturer is established in the Republic of Cyprus.
(v) The essential requirement ( Annex I) paragraph 2.5 that every craft must be accompanied by an owner’s manual is pointed out ( standard 10240 )
(vi) In addition, it is mentioned that there is an inspection of the workshop facilities for checking that this is in accordance with the requirement of the relevant standard, before assigning the manufacturer’s code.

2. Prequisites
(i) An inspection is carried out to check compliance with the provisions in connection with workshop facilities and procedures .The standards in relation to manufacture are noted, also the standard ISO 12215-4 Ηull Construction and Scantlings – Part 4 Workshop and manufacturing, related to the facilities for manufacture and the procedure of construction / production of craft/ hull.
(ii) The manufacturers are obliged to know the relevant legislation and applicable standards and to have access to them.
(α) With the application of valid standards, presumption of conformity is established .
(b) As manufacturers have the obligation to take into consideration the changes of harmonised standards on which the compliance of the product is declared.
(c ) The importer or distributor is considered as manufacturer and shall be subject to the obligations of the manufacturer, according to the provisions of Regulation 8 (PI 191/2017) when he places a product on the market under his name or trademark or modifies a product already placed on the market in such a way that compliance with the requirements may be affected.
In connection with the essential requirement of construction there is clear reference to the following standards:
1. EN ISO 12215-1:2018 Hull construction and Scantlings –Part I – Materials, thermosetting resins, glass- fibre reinforcement , reference laminate .
2. EN ISO 12215-2:2018 Hull construction and scantlings- Part 2 material , core material for sandwich construction, embedded materials
3. EN ISO 12215-3:2018 Hull construction and scantlings- Part 3 Materials : Steel , aluminium alloys , wood , other materials
4. En ISO 12215 -4:2018 Standard for Workshop & Manufacturing
5. EN ISO 12215- 5:2018 Hull construction and scantlings- Part 5 Design Pressures for Monohulls, design stresses, scantlings determination
EN ISO 12215 -6 :2018 Hull construction and scantlings- Part 6 Structural Arrangements and details

3. Certificates
For ensuring the application of Rules and Requirements applicable to recreational craft , personal watercraft and marine engines ( in connection with exhaust and noise emissions ) it is a prequisite to follow the procedure to aquire the CE marking. The manufacturer compiles the Declaration of Conformity as stipulated in Regulation 15 and places the CE marking as stipulated in Regulation 18 and 19.
There is no Certificate issued by the Competent Authority.
For all the modules of assessment except Module A ( internal production control ), a Notified Body is involved , who issues the relevant Certificate according to the applied module of assessment.

4. Legal Reference
(1)The Essential Requirements ( Recreational Craft and Personal watercraft ) Regulations 2017 ( P.I. 191/2017 ) published in the Official Gazette, Annex III (I) number. 5021 dtd 16.6.2017. Above Regulations have been adopted for the purpose of harmonization with the European Directive 2013/53/EU which deals with the Essential Requirements for Recreational craft and Personal Watercraft.
(ii)Law 30(I)/ 2002 for the Essential Requirements for Certain Categories of Products in connection with health, safety and the environment as amended ( 29(I)/2003, 258(I) /2004, 89 (I)/2005 , 71 (I)/2009, 7 (I) 20011 , 54 (I) /2013.
The manufacturer is obliged to apply the procedures of the modules of Assessment specified in the provisions of regulations 21,22 and 23 ( PI 191/2017) before placing the product on the market. The manufacturer compiles the Declaration of Conformity for each product placed on the market and specifies the module of assessment applied. The procedures are fully described in Annex II of the Decision number 768/2008 /EC
Regulation 8 ( P.I. 191/2017) specifies the obligations of the manufacturers.
The Implementing Regulation of 2017/1 deals with the procedure of craft identification. The manufacturer’s code is assigned by the Shipping Deputy Ministry and is used in the creation of the watercraft identification number ( total 14 digits) which must be placed permanently on the craft and constitutes one of the essential requirements according to the Legislation.
